RE: The tariff classification of Abiraterone Acetate (CAS No. 154229-18-2) in bulk form, from India

Dear Mr. Thompson:

In your letter dated January 3, 2020, you requested a tariff classification ruling.

Abiraterone Acetate is a prodrug of Abiraterone and a structural analogue of a steroid hormone with anti-androgen activity. It is indicated for use in combination with prednisone for the treatment of patients with metastatic castration-resistant prostate cancer. You state SST will be importing about 100 grams of Abiraterone Acetate for evaluation by U.S. pharmaceutical companies to develop generic drug products.

The applicable subheading for the Abiraterone Acetate in bulk form will be 2937.29.9095, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Hormones, prostaglandins, thromboxanes and leukotrienes, natural or reproduced by synthesis; derivatives and structural analogues thereof, including chain modified polypeptides, used primarily as hormones: Steroidal hormones, their derivatives and structural analogues: Other: Other: Other.” The rate of duty will be free.
